Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FounderPilot ("Company," "we," "us," or "our"), operated from India, governing your access to and use of the FounderPilot platform available at https://founderpilot.co and all related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Account Registration & Security
You are solely responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized use of your account
We are not liable for any loss or damage arising from your failure to secure your account. You may not share, transfer, or sell access to your account.
3. Description of Service
FounderPilot is an AI-powered growth automation SaaS platform that provides features including but not limited to:
- Lead scanning across Reddit, Instagram, Hacker News, and DEV.to
- AI-generated reply and content generation
- Email outreach automation
- Directory submission services (up to 52 directories)
- SEO content generation
- AI visibility optimization
- Autopilot and Engagement OS features
4. Subscription Plans & Payment
The Service offers the following subscription tiers (prices in INR per month):
- Free — Limited access at no cost
- Starter — ₹999/month
- Growth — ₹2,999/month
- Scale — ₹6,999/month
All payments are processed through Razorpay. By subscribing to a paid plan, you authorize recurring charges to your payment method. You are responsible for any applicable taxes.
5. Free Trial & Refund Policy
Paid plans include a 7-day free trial. You may cancel during the trial period without charge.
After the 7-day trial period, all payments are non-refundable. No refunds will be issued for partial months, unused features, or account termination due to violation of these Terms, unless required by applicable law that cannot be contractually waived.
6. User-Provided API Keys & Third-Party Services
The Service requires you to provide your own API keys for third-party services including but not limited to: Google Gemini, Reddit API, Brevo, Twitter/X API, HikerAPI, and DataForSEO.
You acknowledge and agree that:
- You are solely responsible for obtaining, maintaining, and paying for your own API keys
- All costs incurred through your API keys are your sole responsibility
- We have no control over and accept no liability for third-party API availability, pricing changes, or service interruptions
- You must comply with all terms of service and usage policies of the respective third-party providers
- We are not responsible for any actions taken by third-party providers against your accounts
7. Third-Party Services Disclaimer
The Service integrates with and relies upon third-party platforms and services (including but not limited to Supabase, Railway, Razorpay, Reddit, Instagram, Hacker News, DEV.to, and various API providers). We do not control these services and are not responsible for their availability, accuracy, security, or policies. Your use of third-party services is governed by their respective terms.
We make no representations or warranties regarding any third-party services, and we disclaim all liability for any loss or damage resulting from your use of or reliance on such services.
8. Acceptable Use Policy
You agree NOT to use the Service to:
- Send spam, unsolicited messages, or bulk automated content that violates platform guidelines
- Engage in any illegal, fraudulent, or deceptive activity
- Harass, abuse, or harm any individual or entity
- Violate any applicable law, regulation, or third-party rights
- Distribute malware, viruses, or harmful code
- Scrape, mine, or collect data in violation of platform terms of service
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use the Service to generate content that is defamatory, obscene, or promotes hatred or violence
- Circumvent any rate limits, access controls, or security features
9. Platform Compliance
You are solely responsible for ensuring that your use of the Service complies with the terms of service, community guidelines, and policies of all third-party platforms including but not limited to Reddit, Instagram, Hacker News, DEV.to, Twitter/X, and any email services.
We do not guarantee that actions performed through the Service will comply with any third-party platform's terms. Any consequences arising from violations of third-party platform policies — including account bans, suspensions, or legal claims — are your sole responsibility.
10. AI-Generated Content Disclaimer
THE SERVICE USES ARTIFICIAL INTELLIGENCE TO GENERATE CONTENT INCLUDING REPLIES, EMAILS, AND MARKETING MATERIALS. WE MAKE ABSOLUTELY NO GUARANTEE OF:
- The accuracy, quality, or appropriateness of AI-generated content
- Any specific results, leads, conversions, revenue, or business outcomes
- The suitability of generated content for any particular purpose
- Compliance of generated content with any laws or regulations
You are solely responsible for reviewing, editing, and approving all content before it is published or sent. You assume all risk associated with the use of AI-generated content.
11. Intellectual Property & DMCA
All intellectual property rights in the Service (including software, design, branding, and documentation) are owned by FounderPilot. You retain ownership of content you create using the Service, subject to our license to process it for service delivery.
DMCA Compliance
If you believe that content on our platform infringes your copyright, you may submit a DMCA takedown notice to: founder@founderpilot.co. Your notice must include:
- Identification of the copyrighted work claimed to be infringed
- Identification of the material to be removed
- Your contact information
- A statement of good faith belief that the use is unauthorized
- A statement under penalty of perjury that the information is accurate
- Your physical or electronic signature
We reserve the right to terminate accounts of repeat infringers.
12. Data Processing Disclaimer
While we implement reasonable security measures, you acknowledge that:
- Data is stored in Supabase PostgreSQL databases and processed on cloud infrastructure
- No method of electronic storage or transmission is 100% secure
- We cannot guarantee absolute security of your data
- You are responsible for maintaining backups of any critical data
- We are not liable for unauthorized access resulting from factors beyond our reasonable control

13. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Results obtained from the Service will be accurate or reliable
- The Service will meet your specific requirements
- Any defects will be corrected
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOUNDERPILOT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, REVENUE, GOODWILL, OR ANY OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
This limitation applies regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
15. Indemnification
You agree to indemnify, defend, and hold harmless FounderPilot, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights or platform terms of service
- Content you generate, publish, or distribute using the Service
- Your API keys or third-party account usage
- Any claim that your use of the Service caused damage to a third party
16. Termination
We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for any reason including but not limited to:
- Violation of these Terms or our Acceptable Use Policy
- Abusive, fraudulent, or illegal behavior
- Non-payment of fees
- Requests from law enforcement or government agencies
- Extended periods of inactivity
- Any conduct that we reasonably believe is harmful to other users, third parties, or our business
Upon termination, your right to use the Service ceases immediately. We are not liable to you or any third party for termination of your access. No refunds will be issued for termination due to violations.
17. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You irrevocably consent to the exclusive jurisdiction of courts located in India for any disputes arising under these Terms.
18. Dispute Resolution & Arbitration
ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED BY BINDING ARBITRATION in accordance with the Arbitration and Conciliation Act, 1996 (India), as amended. The arbitration shall be conducted in English, with the seat of arbitration in Bengaluru, India.
Key provisions:
- The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties
- The arbitrator's decision shall be final and binding on both parties
- The arbitral award shall be enforceable in any court of competent jurisdiction worldwide under the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards
- You waive any right to participate in a class action or class-wide arbitration
- Each party shall bear its own costs unless the arbitrator determines otherwise
Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
19. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, government actions, sanctions, embargoes, fire, floods, strikes, power failures, internet or telecommunications failures, cyberattacks, third-party service outages, or any other event beyond our reasonable control.
20. Modification of Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' advance notice of material changes via email or prominent notice on the Service. Your continued use of the Service after the effective date of modified Terms constitutes acceptance of the changes. If you do not agree to the modified Terms, you must discontinue use of the Service before they take effect.
21. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
22. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and FounderPilot regarding the Service and supersede all prior agreements, understandings, and communications.
23. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us to be effective.
24. Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
